Terms & Conditions of Hire

1. The agreement

These terms apply to every vehicle hired from Hyndburn Van Hire Ltd and form part of your hire agreement, together with the booking confirmation and the vehicle condition record signed at collection. By taking the vehicle you accept them. "You" means the person named as hirer on the agreement, who is responsible for the vehicle throughout the hire.

2. Who can hire

You must be aged between 25 and 70, hold a full driving licence valid for the vehicle, and have held it for at least two years. The same applies to any additional driver. These limits are set by our insurers and we cannot make exceptions.

At collection you must produce your photocard licence, a valid DVLA check code, two proofs of address dated within the last three months, and the payment card used for the booking, all in your own name. We can usually insure drivers with up to six points; certain convictions mean we cannot offer a hire. Only drivers named on the agreement may drive the vehicle — if anyone else does, the insurance is void and you will be liable for any claim.

3. Booking, payment and deposit

Hire charges are payable in advance by debit or credit card in the name of the hirer. We do not accept cash. Prices include comprehensive insurance (subject to the excess), RAC breakdown cover, unlimited mileage and VAT.

A refundable pre-authorisation is held on your card at the start of the hire. It is not taken from your account, and it is released once the vehicle has been returned and checked. The amount depends on the vehicle and the level of cover chosen. [Deposit amounts to confirm.]

4. Hire period and returns

Hire periods run on a rolling 24 hours from the time of collection. Collection and return outside standard hours can be arranged in advance at no extra charge.

A 30-minute grace period applies at the end of the hire. After that a further charge applies. If you need the vehicle longer, contact us before the hire ends and we will extend it where the vehicle is available. Vehicles returned outside opening hours are not checked in until the next working day, and you remain responsible for the vehicle until that check is completed.

5. Mileage and fuel

All hires include unlimited mileage within the United Kingdom. There is no mileage allowance and no per-mile charge.

Fuel is on a like-for-like basis. We record the fuel level at handover and ask you to return the vehicle at the same level. If it is returned lower, we will refuel it and charge you for the fuel used plus a refuelling service fee. [Refuelling service fee to confirm.]

6. Using the vehicle

You must keep the vehicle secure, use it only on made-up roads, and comply with all traffic laws. The following are not permitted and will breach the agreement:

  • Taking the vehicle outside the United Kingdom
  • Exceeding the vehicle's 3,500kg gross vehicle weight, or loading it unsafely
  • Carrying hazardous, illegal or unlawfully obtained goods
  • Using the vehicle for hire or reward, driving tuition, racing or off-road use
  • Smoking or vaping in the vehicle — a cleaning charge applies if it is returned smelling of smoke
  • Towing, unless we have agreed it in writing

Dogs are permitted at £20 per day, which covers the deep clean. They must be secured for the whole journey in a harness, crate, carrier or behind a dog guard, as required by Rule 57 of the Highway Code. 7. Insurance and excess

Comprehensive insurance is included, subject to an excess which is the maximum you would pay towards damage or a claim. The excess depends on the vehicle and can be reduced by taking an excess reduction option at the time of booking. Damage to tyres, glass, the roof and the underside, loss of keys, and misfuelling may not be covered by the standard policy. 8. Breakdown, accident and theft

Every vehicle carries RAC breakdown cover. In the event of a breakdown, get somewhere safe, call the RAC on the number on your agreement, in the vehicle and on the keyring, then tell us on 01254 411064.

After an accident, make sure everyone is safe, do not admit liability, exchange details with all parties and take photographs of the scene. Call us immediately and confirm in writing to hello@hyndburnvanhire.co.uk within two business days. Theft must be reported to the police and to us within one business day.

9. Fines and charges

Any fine, penalty, toll, clean air zone or congestion charge incurred while the vehicle is in your care is your responsibility, including anything incurred by an additional driver. Where a notice reaches us we are legally required to name the hirer to the issuing authority, and we charge an administration fee of up to £35 per notice for handling it. Paying a charge yourself at the time is almost always cheaper.

10. Cancellation

Please give us at least 24 hours' notice to cancel or amend a booking. Cancellations with less notice may be charged up to one day's hire. If we have to cancel — for example because a vehicle is damaged or off the road — we will offer an alternative vehicle where we can, or refund you in full.

11. Liability

We are not liable for loss or damage to goods carried in the vehicle, or for indirect or consequential loss such as lost profit or a missed appointment. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Nothing in these terms affects your statutory rights as a consumer.

12. General

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If any part of them is found to be unenforceable, the rest continues to apply.
